Hi there! Here’s the ‘legal stuff’. When booking accommodation with Jephson Hotel Pty Ltd (“the Hotel”), you agree to the following terms and conditions (“the Booking Agreement”). You can find the Booking Agreement at http://www.jephsonhotel.com.au/booking-terms (“the Website”).
Please read the Booking Agreement carefully as you will be legally bound by these terms and conditions once you book. Nothing in the Booking Agreement amends or affects your statutory rights. When you make a booking, you are legally deemed to have read, understood and accepted:
Provision of Information
The Website, and related offline marketing materials, contains information about rooms, facilities and services at the Hotel. While the Hotel will use all reasonable endeavours to ensure the accuracy of available information, the Hotel shall not be liable for any discrepancy, error or omission. The Hotel does not make any representation or warranty, express or implied of any kind regarding any of the information shown on the Website, including related offline promotional materials and third-party booking sites, and shall not be liable for any damages that transpire whatsoever.
1. YOUR BOOKING
On completion of the booking process the Website will email an online confirmation. Your booking is only valid when a booking confirmation email has been issued. If booking by phone, the booking will only be confirmed once you share a valid credit card and a confirmation is sent.
2. HOTEL PRICING
Prices indicated on the Website, including those available on third-party booking websites, for hotel rooms are subject to availability and also subject to change at any time without notice. We encourage you to book early and direct with the Hotel to obtain the lowest available prices.
3. YOUR PAYMENT
Payments may be made by Visa, Mastercard, Diners and American Express and Australian Dollars. The below credit card surcharge will apply:
- 1.5% for Visa Card and Mastercard payments
- 3.5% for Diners and America Express payment
4. RATE POLICIES
The Hotel and Website offer various pricing and rate options. From time to time, special rate types may be available on the Website for the Hotel. Such rates may offer unique policies, inclusions and / or minimum stay rules, and any such policies will override those listed in Section 5, as below. Where a rate is specified as ‘non-refundable’ or ‘advance purchase’, the full payment may be debited immediately once your booking is confirmed.
Except where a difference is specified in Section 4 above, these below cancellation policies will apply to your booking at the Hotel. We strive to ensure fairness and flexibility for all guests.
a) Refunds for Hotel Rooms (including Standard, Easy-Access, Twin Queen, King Spa, Studio and 1 Bedroom Apartment)
- Free cancellation up to 24 hours before your booked check-in date
- Non-refundable if cancelled within 24 hours before check-in date
b) Refunds for Apartments (including our limited inventory Two and Three Bedroom Apartments)
- Free cancellation up to 7 days before your booked check-in date
- Non-refundable if cancelled within 7 days before check-in date
Full payment for non-refundable rates is taken once the booking is received and these bookings are strictly non-refundable and non-changeable.
If any refund is owed, the amount less any applicable merchant credit or debit card processing fees and wire transfer fees, will be refunded to your card within a maximum of 10 business days. The Hotel cannot refund any fees charged by your credit or debit card provider for such transactions.
6. BOOKING VALIDITY
Booking confirmations are provided to you solely for your convenience. The Hotel retains records of all booking transactions including dates of stays and room rates. In the event of any discrepancy, alteration, modification or variation between your confirmation document and the Hotel’s official records, the Hotel’s records shall prevail. Tampering with a confirmation letter to alter details will result in cancellation without refund.
7. CHECK-IN AND OUT
Check-in is available from 2.00pm on the first day of your stay and check out is required by 10.00am on the last day of your stay. For an additional charge of AUD 40 per room, early arrival is available from 12:00pm or a late checkout available until 12.00pm. For a late checkout until 6.00pm, a charge of AUD 150 per room is payable. Early arrivals and late-checkouts are subject to availability and not guaranteed. Please contact the hotel 24 hours prior to arrival or departure to verify if this extra is available. If this extra was booked but unavailable, the extra amount will be refunded.
8. EARLY DEPARTURE
The Hotel will not make any refund if you depart before the previously booked checkout date.
9. HOTEL CURRENCY
Bookings will be charged in AUD, the Hotel’s local currency. Any currency conversion shown is for guidance only. Any refund will be subject to the exchange rate applied by your payment card provider at the time of refund and may differ from exchange rates applied at the time of a payment.
10. AVAILABLE ROOMS
In the event you cannot be accommodated due to the Hotel overbooking or any unforeseen circumstance, the Hotel will use its best endeavours to accommodate you, at its expense, at a comparable property within a 5km radius, for the nights for which the Hotel is unable to accommodate such you. In this unlikely event, the Hotel will arrange or pay for transportation to that property and from that property for a return to the Hotel.
11. TRAVEL INSURANCE
We strongly advise you and your party to purchase travel insurance once you have confirmed your booking, including medical and activity cover.
12. SPECIAL REQUESTS
Once booked, any special request should be made to the Hotel by email or phone. The Hotel cannot guarantee that your request will be possible or honoured. We will endeavour to accommodate your request and ask you to provide reasonable notice, so we can assist with any special plans. You agree that any full or partial failure to fulfil a request, outside the Hotel’s or a rooms normal inclusions, will not lead to a refund being owed.
13. PETS AS GUESTS
We love pets and as much as we’d love you to bring your dog, cat or other pet, the Hotel isn’t pet friendly. We can suggest boarding sites nearby.
14. YOUR OBLIGATION
You agree that you are fully responsible and shall pay for all charges, fees, duties, taxes and other amounts arising out of your booking when due, including additional government taxes and fees applicable. Any violation of the Hotel’s Booking Agreement, may result in immediate cancellation of your booking and forfeiture of any money paid or charging of any money owed for the booking. The Hotel may also charge you for expenses it incurs as a result of any such violations or damages, including those caused or reasonably believed to be caused by anyone that accompanies you.
15. OUR HOTEL SERVICE
In the unlikely event that a problem arises during and related to your stay in the Hotel, you agree to immediately raise the problem with the Duty Manager, who will use their best endeavours to resolve the issue. This will help us to assist you while you’re staying with us and before check-out.
16. SMOKING COURTESY
Jephson Hotel’s interiors are non-smoking environments. Smoking or the smell of smoke in the interior of your hotel room will incur a $500 charge. You’re welcome to smoke on your room balcony. Doors and windows must be closed to avoid the smell of smoke entering your room.
17. INTELLECTUAL RIGHTS
Any copyright and other intellectual property in the content and materials on the Website or at the Hotel remains with the Hotel. Downloading, copying or otherwise using any material from the Website is permitted solely for private use for the purpose of booking your stay with the Hotel.
18. FORCE MAJEURE
The Hotel will not be liable for any change or cancellation of any booking or payment that is caused, in whole or in part, by events, occurrences, or causes beyond the control of the Hotel. Such events, occurrences, or causes include, without limitation, acts of God, terrorist activities, weather, strikes, lockouts, riots, flight delays, acts of war, and any earthquake, volcanic activity, ash clouds, fire and explosions, whether occurring near the Hotel or at any other location worldwide. Please see Section 8. We encourage you to secure a sufficient travel insurance policy prior to travelling.
The Hotel may cancel, modify and report bookings to the relevant authorities, when it appears that a user has engaged in fraudulent, criminal or other inappropriate activity or under other circumstances where it appears that the bookings contain or resulted from a mistake or error. You are advised that the Hotel has CCTV cameras and you understand that recorded footage may be shared with law enforcement agencies as required.
20. GOVERNING LAW
This Booking Agreement is governed by the laws of Queensland, Australia and the courts of Queensland shall have the exclusive jurisdiction in relation to any disputes. If any term or condition of this Booking Agreement is ruled invalid, all other terms and conditions shall still fully apply.
21. GUEST EMAILS
By making a booking, you give permission for the Hotel to contact you by email. To ensure booking confirmations are received, we recommend adding our URL to your safe senders list. We respect your privacy and you are welcome to ‘Unsubscribe’ any time by clicking on ‘Unsubscribe’.
